THE EXPROPRIATION BILL HAS BEEN PASSED – BUT CONCERNS REMAIN

The National Assembly has passed the Expropriation Bill and should the President assent to it, South Africa will have a new Expropriation Act.

The new Expropriation Act has been a long time coming, the quest having begun in 2008, with the previous versions lapsing in Parliament over concerns with their constitutionality. In many respects, this version is perhaps the best thus far. That is not to suggest that the new Expropriation Bill is without fault.

Parliament Approves Land Expropriation Bill

The bill will enable the state to pay for land at a value determined by a government adjudicator.

South Africa’s parliament on Thursday approved a bill allowing state expropriations of land to redress racial disparities in land ownership, an emotive issue two decades after the end of apartheid.

Most of South Africa’s land remains in white hands and many commercial and small-scale farmers are currently facing tough times because of the worst drought in at least a century.
