To all property practitioners – Principals, Agents and Interns

Firstly, I would like to thank you all for utilising the online 2020 FFC platform we launched on 15 November 2019.  Through this platform we were able to ascertain the dire extent of the FFC backlog.

At a Multi Stakeholder Group meeting held on 22 November, 2019, we alerted the CEO of the EAAB to the impending crisis of the backlog in issuing FFCs. When referred to the situation as a crisis, Ms Mohlala insisted that it is too strong a word to describe the situation – without admitting the extent of the problem.

Following the huge volume of queries we received from industry, a meeting was arranged on Tuesday 10 December 2019, with the CEO of the EAAB – Ms Mohlala and the Chairman of the Board – Mr  Nkosinathi Biko.

I can confirm that as of that meeting, the following statistics were revealed to us:

A total of 29 272 Agents were compliant and ready for processing.

To date 19 850 FFCs have been issued and uploaded to respective agent profiles.

9 422 FFCs remained un-issued.

We were shocked to realise that the problem in hand was even bigger than we thought.

We have been given an undertaking by the CEO that EVERY FFC will be issued on or before the EAAB close for the festive season on 20 December 2019. We have also insisted on an undertaking that the EAAB not close for the year until all certificates have been issued.

In addition, we have been promised updates on progress to determine the rate of processing until the deadline date.  The CEO, Ms Mohlala, has further gone on record to provide industry with ongoing updates through press statements on their website and in local media, the first which appeared on 12 December.

Many of you have sent follow-up emails to us, requesting updates on your 2020 FFCs.  As per the statistics mentioned above, I’m sure you can understand that given the volumes, we cannot attend to each query on a case by case basis.  Please be assured that if you have logged a query on our website, your FFC renewal is receiving our urgent attention and as per the CEO of EAABs promise, you will have it before 20 December 2019

I would like to assure the industry, that we are taking this matter seriously and have escalated it to the highest level including correspondence to the Minister, Chief of Staff, Director General, Parliamentary Portfolio Committee of Human Settlements and the EAAB Board.

We will continue to work together with all role players until each and every one of you has their FFC.

Rebosa are adamant that the industry will not start the New Year with compliant agents being penalised due to the ineptitude of the regulator, and thereby deprived of their livelihoods’.  We can assure you that we will use all means available to us, inclusive of litigation, to ensure same.

I thank you for your patience and understanding and again assure you of our commitment to resolve this issue.

If you still do not have your FFC, paid before the cut-off date of 31 October 2019, and have lodged a complaint with the EAAB on your MyEAAB portal and received a reference number from them, I urge you to visit our website and complete the form, so that we can assist you.

As Rebosa’s mission statement declares, “REBOSA is a unified and representative organisation that aims to safeguard and protect the interests of real estate business owners in South Africa. REBOSA will achieve collectively what business owners cannot achieve on their own”.

Over the past weeks, we have been doing exactly what our mandate requires of us.

I will be providing updates on this crisis next week.

Many thanks and kind regards

Jan le Roux
